Background
A defect has been identified in Ford’s DPS6 dual-clutch “PowerShift” Transmission, affecting certain Ford Fiesta (2011–2019), Focus (2012–2018), Kuga (2011–2018), and EcoSport (2013–2017) models.
This transmission system was designed to offer smooth gear changes like an automatic, but it operates more like a manual. It uses a “dry clutch” technology, which lacks lubrication and is prone to overheating. As a result, many drivers have experienced serious performance and safety issues—including sudden loss of power and the inability to accelerate, which can increase the risk of accidents.
Although the dry clutch design is lighter and cheaper to produce, it has proven to be unreliable and flawed, leading to widespread concerns among affected vehicle owners

Why am I entitled to compensation?
You may be entitled to compensation as it is alleged that the potential defendants misreported and misrepresented the fuel efficiency and emission performance of certain Mercedes Diesel vehicles. These actions may have caused the class members to suffer damages.
Am I entitled to compensation if my vehicle is not listed?
You may be entitled to compensation if it is determined that your model year and specification was an affected class vehicle. Please provide us with the model year and specification of your diesel vehicle. At a later stage, we will request more information about your circumstances.
Can I still register even if I no longer own an affected vehicle?
Yes, you are still eligible to register for the class action if:
- you have since sold your affected vehicle; or
- the vehicle has been written off or stolen.

How much will I be compensated?
It is too early to predict how much you may ultimately recover. However, should proceedings be commenced, we will be seeking the maximum recovery available under the law.
Do I have to appear in court?
No. As a member of the class (and not the Representative Plaintiff, in whose name the case has been brought), you will not be required to appear in Court. If you are chosen as a representative plaintiff, your appearance in Court may only be required after the class action proceedings have been approved by the Court (this process of approval is referred to as certification in South Africa).
How much does it cost to become part of the class action?
There is no upfront cost to registering for the class action. All costs will be borne by RH Lawyers, and/or a litigation funder, unless and until there is a successful outcome. In the event of a successful outcome, any costs payable by RH Lawyers or a litigation funder will be deducted from the damages award and/or compensation to class members. All such cost deductions are required to be considered and approved by the Court.
