The catastrophe began with the breach of a dam wall on the 8th of August 2024, which triggered the failure of adjacent dams. Days later, a further dam wall also gave way. Investigations conducted by the Department of Water and Sanitation (“DWS”) have revealed serious structural deficiencies of the dams in question, including internal erosion and the absence of sufficient spillways.
Critically, none of the dams were registered or subject to the required inspections and repairs and maintenance, despite being classified as safety risks.
Importantly, warnings by the local community about the poor state of repair of the dams and dam structural vulnerabilities were ignored by both authorities.
This class action aims to hold those accountable that are responsible for the structural failures and regulatory oversights that led to the disaster.
